1. Scope of Services: Garden Knights and its associates (hereinafter referred to as “Service Provider”) agree to provide lawn care services to the customer (hereinafter referred to as “Customer”) as outlined in the agreed-upon service plan. Services may include mowing, pruning, bush maintenance, weed control, fertilizing, and repairing bare grass spots. Any additional services must be explicitly agreed upon in writing.

 

2. Pricing and Payment: The Customer agrees to pay the Service Provider the price agreed upon between both parties for the lawn care services provided. Payment is due in cash, with 50% of the total cost payable prior to the commencement of services and the remaining 50% due upon completion. In the event of late payments, the service provider reserves the right to apply a late fee at it's discretion.

3. Cancellation and Rescheduling Policy: The Customer may cancel or reschedule services by providing at least 3 days’ advance notice. Cancellations before the 3-day mark will be eligible for a 90% refund of the total service cost. Rescheduling before or on the 3-day mark will be eligible for a free 1 time reschedule. Any reschedules after which will result in a fee of  $2.50. Cancellations after the 3-day mark will not be eligible for any refund and may incur a cancellation fee. The cancellation or rescheduling fee is $5 for the first day, with an additional fee of $2.50 for each subsequent day past the 3-day mark.

4. Property Access and Missed Appointment Fee: The Customer agrees to provide Garden Knights with access to the property at the location specified by the Customer on the scheduled service date and time. If access is not provided or if the Customer misses the scheduled appointment without prior notice, Garden Knights reserves the right to charge a missed appointment fee. The missed appointment fee will be determined by Garden Knights based on factors such as the reason for the missed appointment, the Customer’s history with Garden Knights, and other relevant circumstances. This fee may range from $0 to $30 and will be applied at Garden Knights’ discretion.

5. Data Collection and Privacy: Garden Knights collects and stores personal information provided by Customers, including their full name, email address, phone number, and address, for the purpose of scheduling and providing lawn care services. We are committed to protecting the privacy and security of this information and will not disclose or sell it to third parties without the Customer’s consent, except as required by law. Garden Knights implements appropriate measures to safeguard the confidentiality and integrity of Customer data. By providing this information, Customers consent to its use for the purposes outlined above.

6. Liability: The Service Provider shall not be liable for any damages to property or injury to persons arising out of or related to the provision of lawn care services, except to the extent caused by the gross negligence or willful misconduct of the Service Provider.

7. Indemnification: The Customer agrees to indemnify and hold harmless Garden Knights, its

owners, employees, agents, and representatives from any claims, damages, liabilities, costs, or expenses arising out of or related to the Customer’s use of the lawn care services.

8. Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of the state of Minnesota, without regard to its conflict of law principles.

9. Dispute Resolution: Any disputes arising under these terms and conditions shall be resolved through mediation or arbitration as mutually agreed upon by the parties, prior to seeking resolution in a court of law.

10. Changes to Terms and Conditions: The Service Provider reserves the right to modify or update these terms and conditions at any time. Changes will be effective immediately upon posting on the Service Provider’s website or other means of communication.

 

11. Entire Agreement: These terms and conditions constitute the entire agreement between the Service Provider and the Customer regarding the provision of lawn care services and supersede all prior agreements and understandings, whether written or oral.

 

 

 

 

Garden Knights Liability Waiver

 

By scheduling or accepting lawn care services from Garden Knights, I acknowledge and agree to the following:

 

1. Acknowledgment of Risks: I understand that lawn care services involve certain risks, including but not limited to injury, property damage, or other accidents arising from the use of equipment or chemicals in the process of providing these services.

 

2. Waiver of Liability: I, on behalf of myself, my family, heirs, and assigns, hereby waive any and all claims, liabilities, or demands of any kind against Garden Knights, its owners, employees, agents, or associates, arising out of or in connection with any damages or injuries that occur during or as a result of the lawn care services provided.

 

3. Indemnification: I agree to indemnify and hold harmless Garden Knights and its associates from any and all claims, actions, or damages resulting from my use of or involvement with the lawn care services, including claims arising from the acts or omissions of any third parties.

 

4. Assumption of Responsibility: I understand that it is my responsibility to ensure that my property is accessible and free of any obstacles, pets, or hazards that may pose a risk to the service providers or their equipment. I further agree to notify Garden Knights of any specific instructions or concerns regarding my property.

 

5. Medical Consent: In the event of an emergency while providing lawn care services, I give my consent for any necessary medical treatment to be administered to the service provider or any individual involved in the provision of services.

 

6. Governing Law: This waiver shall be governed by and construed in accordance with the laws of the state of Minnesota, without regard to its conflict of law principles.

 

7. Entire Agreement: This Liability Waiver represents the entire agreement between the parties and supersedes all prior agreements and understandings related to the lawn care services provided by Garden Knights.
